What Title 42’s End Means for Biden

Last week saw the end of the Trump Administration COVID-era Title 42 policy that allowed the expulsion of thousands of illegal immigrants weekly. New polling from Morning Consult shows this will be problematic for President Biden as he ramps up his reelection campaign.

Why It Matters: With the limited messaging that has taken place on the issue so far, the negative effects of the Biden Administration’s decision to end the use of the Title 42 policy are already being seen. It’s likely this decision will have an outsized influence on the 2024 presidential contest. 

 

By The Numbers:

  • 51% oppose rescinding Title 42, while 37% support its end; this marks a 3-point shift in each number from April 2022, when messaging around this issue was at its high.
  • 79% of Republicans oppose rescinding Title 42 while 60% of Democrats support the move by the Biden Administration. 
  • 57% of Independents (up 6-points from last year) oppose rescinding the policy, while 27% support it (a decrease of 4-points).

 

Rescinding Title 42 without any plan or policy in place to deal with the continuing flood of migrants at the border is not popular with the Americans, and is likely to grow less popular. President Biden and Democrats are at odds with where most Americans stand. From May 13 to today, President Biden has seen his net disapproval averaged across all public polling fall to -11.2 from -10.0 according to the FiveThirtyEight presidential approval rating calculation.

The Bottom Line: This is an issue for Republicans to focus on connecting with Independent voters, that will put Biden even more on the defensive with the public. The GOP and its candidates should invest heavily in keeping pressure on the Biden Administration by advocating the real answers to make the border strong and secure, coupled with structural reforms to the immigration system.
